1. ENGAGEMENT & ACCEPTANCE

By accessing this website (thepixelxmedia.in), commissioning studio work, or submitting an inquiry via our Contact or Request a Quote forms, you agree to be bound by these Terms and Conditions.

These terms govern all commercial proposals, project statements of work (SOW), creative execution, and technical deliverables provided by PixelXMedia to clients worldwide.

2. SCOPE OF SERVICES

PixelXMedia provides premium creative technology and digital growth services, including:

• Custom Web Development, Next.js architecture, WebGL 3D experiences, and platform engineering.
• Digital Marketing, paid acquisition funnels, and programmatic growth infrastructure.
• Social Media Strategy, creative direction, and viral editorial content.
• SEO Architecture, technical performance audits, and search landscape authority.
• Events, Spatial Exhibitions, trade pavilion architecture, and BTL on-ground brand activations.
• Cross-media Advertising, Digital Out-Of-Home (DOOH), and commercial copywriting.
• Commercial Product Photography, cinematography, 360-degree interactive visual assets, and CGI.

3. PROPOSALS, ESTIMATES & MILESTONE PAYMENTS

All project estimates are issued based on mutually agreed scope documents. Formal engagements proceed pursuant to structured milestone payment schedules:

• An initial mobilization deposit is required prior to project kickoff, discovery, and architecture planning.
• Subsequent milestone payments correspond to tangible delivery stages (e.g. design approvals, development staging, pre-launch verification).
• Final code releases, production domain deployments, and high-resolution master asset deliveries occur upon completion of final milestone settlement.

4. INTELLECTUAL PROPERTY OWNERSHIP

We believe in complete client sovereignty over their custom brand assets:

• Client Deliverables: Upon receipt of full settlement, all custom frontend designs, brand copy, custom graphics, and bespoke codebases created specifically for the client become the client's exclusive property.
• Studio Tooling: PixelXMedia retains ownership of proprietary internal boilerplates, developer tools, and pre-existing WebGL shaders, granting the client a perpetual, non-exclusive, royalty-free license to use them in the delivered platform.
• Portfolio Rights: Unless explicitly restricted by an executed Non-Disclosure Agreement (NDA), PixelXMedia reserves the right to feature completed projects in studio portfolios, case studies, and creative awards.

5. CLIENT RESPONSIBILITIES & APPROVALS

Prompt project execution relies on collaborative coordination. Clients agree to provide timely feedback, brand guidelines, and requisite third-party credentials (domain registrar, API keys, merchant accounts) required for project milestones.

6. REVISIONS & SCOPE VARIATIONS

Each statement of work includes defined revision cycles for design concepts and technical iterations. Requests for features, integrations, or fundamental design pivots outside the agreed statement of work will be scoped as an addendum with transparent pricing and timeline adjustments.

7. MUTUAL CONFIDENTIALITY & NDA PROTECTION

Both parties agree that all trade secrets, unreleased product plans, financial figures, customer data, and proprietary source code exchanged during an engagement shall remain strictly confidential. We regularly execute formal mutual NDAs upon client request prior to initial technical discovery.

8. LIMITATION OF LIABILITY & WARRANTIES

PixelXMedia warrants that all engineering code and creative deliverables are executed with the highest industry standards of professional craftsmanship and performance optimization.

To the maximum extent permitted by applicable law, PixelXMedia shall not be liable for indirect, consequential, or speculative damages arising from third-party hosting outages, upstream API disruptions, or client-initiated modifications to delivered production environments.

9. GOVERNING LAW & JURISDICTION

These Terms and Conditions and any contractual disputes arising hereunder shall be governed by and construed in accordance with the laws of the Republic of India. The courts of competent jurisdiction in India shall have exclusive jurisdiction over any legal proceedings.
